These Terms and conditions govern your use of the website located at https://www.6ixiron.com and any related services provided by “6ix Iron Inc” including access to our facility located at 142 George St, Toronto ON (“Facility”).
By accessing https://www.6ixiron.com or accessing our Facility you agree to abide by these Terms and conditions and to comply with all applicable laws and regulations. If you do not agree with these Terms and Conditions, you are prohibited from using or accessing this website or using any other services provided by 6ix Iron Inc.
We, 6ix Iron Inc., reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page. Any changes to these Terms and Conditions will take effect immediately from the date of publication.
By entering the facility, or by booking with 6ix Iron Inc., you hereby agree to all the below Terms and Conditions.

Limitation of Liability
Our website and the materials on our website are provided on an ‘as is’ basis. To the extent permitted by law, 6ix Iron Inc. makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property, or other violation of rights.
In no event shall 6ix Iron Inc. or its suppliers be liable for any consequential loss suffered or incurred by you or any third party arising from the use or inability to use this website or the materials on this website, even if 6ix Iron Inc. or an authorized representative has been notified, orally or in writing, of the possibility of such damage. In the context of this agreement, “consequential loss” includes any consequential loss, indirect loss, real or anticipated loss of profit, loss of benefit, loss of revenue, loss of business, loss of goodwill, loss of opportunity, loss of savings, loss of reputation, loss of use and/or loss or corruption of data, whether under statute, contract, equity, tort (including negligence), indemnity, or otherwise.
Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
1. Acknowledgment of Risk
By using the indoor golf simulator ("Facility") provided by 6ix Iron Inc., you acknowledge and agree that the use of the Facility involves certain inherent risks, including, but not limited to, physical injury, property theft or damage, and other potential hazards associated with playing or interacting with the equipment. You agree to voluntarily assume all risks associated with your participation in any activities at the Facility, whether or not such risks are known or foreseeable.
2. Limitation of Liability
To the fullest extent permitted by applicable law, 6ix Iron Inc., its officers, employees, agents, contractors, and affiliates (collectively, the "Released Parties") shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any loss of income, profit, or data, arising out of or in connection with your use of the Facility, including, but not limited to, any injury, damage, or loss of personal property, whether caused by negligence, breach of contract, or otherwise.
3. Waiver and Release
By entering the Facility, you waive any and all claims, demands, or actions against the Released Parties arising from any injury, loss, or damage that may occur while using the Facility, including any injuries sustained due to the malfunctioning of equipment, slip and fall incidents, golf ball or club impact, or any other occurrences within the premises. You further agree not to hold the Released Parties responsible for any injuries caused by your own actions or the actions of other participants.
4. Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, liabilities, losses, damages, expenses (including legal fees), or other costs arising from your use of the Facility or any violation of these terms and conditions.
5. Governing Law
This Limitation of Liability shall be governed by and construed in accordance with the laws of the Province of Ontario, and any disputes arising out of or in connection with the use of the Facility shall be subject to the exclusive jurisdiction of the courts located in Ontario.
Access Policy
At 6ix Iron Inc, we are committed to providing a safe, enjoyable, and exclusive experience for our customers. Access to our indoor golf simulator facility ("Facility") is restricted to individuals who have a confirmed booking or reservation. To ensure the privacy and security of our patrons and staff, the following Access Policy is in effect:
1. Authorized Access
Only individuals who have made a confirmed booking via our official reservation system are permitted to enter the Facility. A valid booking must be made prior to arrival, and all users must present confirmation of their booking upon entering.

Bookings: Reservations can be made online through our website or by email. All bookings must be confirmed and paid for in advance to ensure access.

Booking Confirmation: A valid booking confirmation must be presented at the front door upon arrival.
2. Maximum Number of Guests
Each booking is permitted to accommodate a maximum of four (4) individuals per simulator session. No more than four guests may use the Facility at any given time, including the person who made the reservation.

Additional Guests: If you wish to add more than four guests, you must make an additional booking for another simulator session, subject to availability.
3. No Unauthorized Access
Any person attempting to enter the Facility without a valid, confirmed booking or in excess of the maximum guest limit, or beyond the permitted access time, will be considered a trespasser. Unauthorized individuals may not enter the premises or use any of the equipment.

Trespassing: Any individual found inside the Facility without a valid booking or after the conclusion of their scheduled time will be asked to leave immediately.

Violations: Individuals caught violating this policy may be subject to legal action, including but not limited to trespassing charges under the Criminal Code of Canada.
4. Property and Safety Concerns

Access Restrictions: The Facility is private property, and only those with proper authorization (i.e., confirmed bookings) are allowed to enter. Any person found inside the Facility without proper authorization may be escorted out by staff or security personnel.

Providing Access to Unauthorized Individuals: Access shall not be given to unauthorized individuals and you may be liable for damages caused by the unauthorized individual.

Security: Our staff is trained to monitor the premises to ensure that only authorized individuals are present. Surveillance cameras are in place throughout the Facility to ensure the safety and security of all patrons. By entering our facility, you consent to being recorded and monitored by the security system.
5. Cooperation with Staff
By entering the Facility, all guests agree to cooperate with staff and comply with all policies and instructions regarding access. Failure to do so may result in immediate removal from the premises and the cancellation of any future bookings.
6. Enforcement and Consequences
Any violation of this No Trespassing Policy may result in:

Suspension or revocation of future booking privileges

Legal action as necessary, including criminal charges for trespassing

A ban from the Facility at the sole discretion of 6ix Iron Inc. management
This Access Policy is intended to protect the privacy, security, and enjoyment of our patrons and staff. It ensures that only those who have properly booked and paid for their sessions, and who comply with our guest limits, can access the indoor golf simulator facilities. All visitors are expected to respect this policy to ensure a safe and enjoyable experience for everyone.
Membership Policy
By becoming a member of 6ix Iron you agree to the following policies which apply to all Birdie, Eagle and Albatross members.

6ix Iron reserves the right to make changes to membership pricing or membership benefits at any time including but not limited to: booking fees, monthly hour quotas, daily booking quotas, membership fees. Updated rates or member benefits will be reflected on our website from time to time under “Membership and Rates”.

Members must abide by all other written policies contained herein including Access Policy and Guest Conduct Policy.

Members must be physically present for the full duration of any bookings made through the member’s account.

Members must not share their membership benefits with a third party. This includes making bookings for a third party or allowing a third party to make bookings using their membership.

Management reserves the right to enforce this policy which may include suspension or revocation of membership without refund.
Guest Conduct Policy
At 6ix Iron, we are committed to providing a welcoming, safe, and enjoyable environment for all guests and employees. We expect all patrons to behave in a manner that is respectful, responsible, and in compliance with the following guidelines. This policy aims to maintain a positive atmosphere for everyone while ensuring the safety and well-being of both guests and staff.
By entering 6ix Iron Inc., you agree to comply with this Guest Conduct Policy. Failure to do so may result in removal from the premises and potential refusal of service.
1. Respectful Behavior and Harassment Prevention
We strive to create a respectful environment for all guests and staff members. Harassment, discrimination, or inappropriate behavior towards employees or other patrons will not be tolerated. This includes, but is not limited to:

Verbal Harassment: Offensive comments, slurs, insults, or discriminatory remarks based on race, gender, sexual orientation, religion, disability, or any other personal characteristic.

Physical Harassment: Any unwanted physical contact, such as touching, pushing, or aggressive behavior.

Sexual Harassment: Unwelcome advances, comments, or gestures of a sexual nature.

Intimidation or Bullying: Any behavior designed to frighten, coerce, or demean others.
Guests who engage in harassment will be asked to leave immediately and may be banned from returning. Employees have the right to refuse service to anyone exhibiting disruptive or harmful behavior.
2. Smoking and Vaping
6ix Iron Inc. maintains a smoke-free environment in compliance with the Ontario Regulations, As such:

No Smoking: Smoking of any kind, including marijuana, cigarettes, cigars, and pipes, is strictly prohibited inside the premises.

No Vaping: Vaping, e-cigarettes, and similar devices are also prohibited inside the bar. Please use designated smoking areas outside if necessary.
Failure to comply with the no smoking and no vaping policies will result in immediate removal from the premises.
3. Alcohol Consumption and Responsible Drinking
We are committed to ensuring the safety and well-being of all guests. Excessive drinking, disruptive behavior, and intoxication that leads to unsafe or inappropriate actions are not tolerated. To promote responsible drinking:

No Excessive Drunkenness: Guests who are visibly intoxicated, or who engage in disruptive behavior due to excessive alcohol consumption, will be asked to leave immediately.

Refusal of Service: Our staff has the right to refuse alcohol service to any guest who appears intoxicated or is behaving inappropriately. This includes aggressive, disrespectful, or unsafe behavior.

Safe Transportation: Guests are encouraged to use designated drivers, taxis, or rideshare services (e.g., Uber, Lyft) if they plan to consume alcohol.
4. Disorderly Conduct and Disruptions
We maintain a lively and fun environment, but disruptive or aggressive behavior is not tolerated. Guests must:

Behave Appropriately: Aggressive behavior, shouting, fighting, or other actions that disturb the peace will result in immediate ejection from the premises.

Respect Staff and Other Guests: All patrons are expected to treat staff and fellow guests with courtesy and respect. Rude, aggressive, or threatening behavior will not be tolerated.
5. Dress Code and Personal Belongings
6ix Iron Inc. reserves the right to establish a dress code to ensure a comfortable and safe atmosphere. As such:

Appropriate Attire: We require patrons to wear appropriate clothing, including shirts and shoes, while inside the bar.

No Offensive Clothing: Clothing with offensive language, symbols, or graphics that may cause disruption or discomfort to others will not be allowed.
Guests should also be mindful of their personal belongings. We are not responsible for lost or stolen items.
6. No Outside Food or Drinks
To ensure the safety, cleanliness, and quality of our offerings, no outside food or beverages (including alcohol, snacks, and non-alcoholic drinks) are allowed on the premises. All food and drink must be purchased from the bar or vending machines.

Exception for Special Occasions: Any exceptions (e.g., for birthday cakes or dietary restrictions) must be pre-approved by management and are subject to specific guidelines.
Guests found violating this policy by bringing in outside food or drink may be asked to leave or have the items confiscated.
7. No Weapons or Illegal Substances

Weapons: No firearms, knives, or other weapons are allowed on the premises. Violators will be reported to authorities and removed from the property.

Illegal Substances: The use or possession of illegal drugs or substances is prohibited. Any guest found in violation of this policy will be immediately removed from the premises, and authorities may be contacted.
8. Compliance with Local Laws and Regulations
All guests must comply with applicable local, provincial, and federal laws, including those regarding the legal drinking age, public behavior, and health and safety regulations. 6ix Iron Inc. reserves the right to involve law enforcement if necessary, including in cases of underage drinking or other illegal activities.
9. Enforcement and Consequences
Failure to comply with any part of this Guest Conduct Policy may result in the following:

Immediate Removal: Any guest engaging in disruptive or unsafe behavior will be asked to leave immediately.

Ban from Premises: Guests who repeatedly violate this policy may be banned from the premises for a specified period or permanently.

Police Involvement: In cases of illegal activity or violent behavior, law enforcement may be contacted, and the individual may face legal consequences.
Use of our Site
You agree to use our website for legitimate purposes and not for any illegal or unauthorized purpose, including without limitation, in violation of any intellectual property or privacy law. By agreeing to the Terms, you represent and warrant that you are at least the age of majority in your state or province of residence and are legally capable of entering into a binding contract.
You agree to not use our Site to conduct any activity that would constitute a civil or criminal offence or violate any law. You agree not to attempt to interfere with our Site’s network or security features or to gain unauthorized access to our systems.

Cancellation Policy
Bookings may only be cancelled, at no charge, via email, up to 24 hours prior to the start of the booking (“Cancellation Period”). Once the Cancellation Period has completed, the reservation is final and no modifications or changes are allowed. At the discretion of 6ix Iron Inc., we reserve the right to refuse cancellation privileges, service, or product to anyone seen abusing this privilege. 6ix Iron Inc. reserves the right to issue full or partial refunds to the credit card on file at their sole and unfettered discretion notwithstanding the 24-hour no-refund no-cancellation policy.
Payments/Credit Card
All bookings require a valid credit card. Your card will be charged immediately upon successful booking. No credit card information is stored with us. Bookings are completed on a third-party booking platform. We are not responsible for the Privacy Policy or Terms of Service of these third-party websites.
Damage to Facility & Litter on Property
6ix Iron Inc. reserves the right to charge the payment method used at the time of booking for any and all damages to the facility, its property, and its equipment caused by guests. This includes but is not limited to: Screen damage due to use of personal balls, missing or stolen items from the bay, damage to all equipment such as but not limited to; computers, monitors, simulator sensors, lights, fixtures, structural components, turf, balls, tees, furniture. Minimum charge for the above aforementioned will be $50.00 CAD. All customers are responsible for any of their booked guests and their actions.
6ix Iron Inc. reserves the right to charge the payment method used at the time of booking for any waste left behind in our indoor golf facility, including but not limited to broken tees, broken balls, garbage, and other debris. 6ix Iron Inc. provides garbage and recycling bins to dispose of litter. A separate minimum charge of $70, up to a maximum of $140, will cover the expenses incurred for additional unscheduled cleaning and maintenance. All customers are responsible for any of their booked guests and their actions.
